Texting While Driving: $500,000 Later

David and Linda Kubert’s lives were changed forever when a teenager who was texting while driving hit them on their motorcycle. They each lost a leg from the effects. 3 years later, the lawsuit is settled, and the driver has been fined $500,000. The Huffington Post states that “The settlement amount for David and Linda Kubert equals the maximum payment driver Kyle Best’s insurance would cover.”

David’s left leg was torn off above the knee during the accident while Linda’s left leg was later amputated. David can’t work because of the injury, causing many financial problems.

Kyle Best, the driver who hit David and Linda, was ordered to speak to 14 high schools about the dangers of texting while driving. Even though his driver’s license was not suspended, he still have to pay a fine of $775.

#1 Reason For Traffic Accidents

ST. GEORGE – A two-vehicle accident just before 8 a.m. this morning slowed traffic to a crawl on Sunset Boulevard.

Sgt. Craig Harding said a gray Toyota pickup truck going northbound in the left turn lane allegedly failed to yield to a vehicle going southbound and the driver was ticketed. Semi-Truck Accident On I-15 Kills 2 People

Another Tragic Semi-Truck Accident Killing Two People on I-15

On Sunday, July 19, 2010, Russell W. Welsh and Emelda Welsh, of Finleyville, Pennsylvania were tragically killed when, according to news reports, a driver of a semi-truck traveling northbound at a high rate of speed failed to see that the traffic had slowed and swerved into the Southbound lane, killing Russell and Emelda Welsh. 

This tragic accident happened on I-15, in Southern Utah, near Pentura in Washington County. Our heartfelt condolences go to the Russell and Emelda Welsh family. 

 According to one news report, officials believe that the driver of the semi-truck was not paying attention to existing traffic conditions.  Because this accident involved a semi-truck, a post-accident drug test should be performed pursuant to the provisions of 49 CFR 382.303, which provides, in relevant part:

“(a) As soon as practicable following an occurrence involving a commercial motor vehicle operating on a public road in commerce, each employer shall test for alcohol for each of its surviving drivers:  . . .   (2) Who receives a citation within 8 hours of the occurrence under State or local law for a moving traffic violation arising from the accident, if the accident involved:  (i) Bodily injury to any person who, as a result of the injury, immediately receives medical treatment away from the scene of the accident; or  (ii) One or more motor vehicles incurring disabling damage as a result of the accident, requiring the motor vehicle to be transported away from the scene by a tow truck or other motor vehicle.   (b) As soon as practicable following an occurrence involving a commercial motor vehicle operating on a public road in commerce, each employer shall test for controlled substances for each of its surviving drivers:  . . .  (2) Who receives a citation within thirty-two hours of the occurrence under State or local law for a moving traffic violation arising from the accident, if the accident involved: (i) Bodily injury to any person who, as a result of the injury, immediately receives medical treatment away from the scene of the accident; or (ii) One or more motor vehicles incurring disabling damage as a result of the accident, requiring the motor vehicle to be transported away from the scene by a tow truck or other motor vehicle.” 

In any accident involving a semi-truck, immediate action should be taken to prevent destruction or loss of the following important information: 

            1.         The truck driver’s complete employment file, including but not limited to his or her qualification file and all incident reports involving the driver.

            2.         The truck driver’s logs and other driving records.

            3.         Any and all pre and post-accident drug tests administered to the driver – DOT regulations require mandatory drug testing under certain circumstances.

            4.         Any and all compliance audits involving the driver and the trucking company.

            5.         Any satellite tracking information relating to the truck and its whereabouts.

            6.         Any and all information contained in or from on-board data recorders, such as ECM units, also called black boxes, inclinometers, etc.

             7.         Records of any and all communications between the truck driver and his employer or any other person at time periods relevant to the collision.

             8.         Maintenance records, pre-trip inspection reports, post-trip inspection reports and annual inspection reports for the truck involved in the collision.

             9.         Any and all incident reports relating to the truck driver.

             10.       Any and all incident reports relating to the trucking company.

             11.       Any and all trip receipts, weight tickets, bills of waiting and other operational documents relating to the trip the driver was on when the collision occurred.   

             12.       The truck driver’s cellular phone records for several days before the collision.

Local Teens Learn Dangers of Texting

“Is any message worth losing your life over?” Reggie Shaw asked Dixie High School students.

Three years ago, Reggie Shaw was responsible for the deaths of two men as he was sending and receiving text messages while driving in Cache County.

Students at Dixie High School had the opportunity to hear his story firsthand earlier this month during an assembly according to an article in The Spectrum.

Shaw said he was 19 years old when the accident happened. He was off to work, just like any other day.

“I made the choice to text and drive,” he said. “I’d done it before and didn’t think it was dangerous.”

While on his way to work, Shaw crossed the center line and hit the oncoming vehicle. The vehicle spun and was hit by the vehicle behind Shaw.

“These two men were husbands and fathers,” he said.

Shaw was charged with negligent homicide. He served 30 days in jail and was required to do 100 hours of community service. His service has been talking to youth about the dangers of texting while driving.

“It’s been three years (since the accident), and it (talking about it) never gets easier. This assembly is no easier than the first one,” Shaw said.

He added he hopes he makes a difference.

“It really helps me come to peace with what happened, knowing I might be saving someone else’s life,” Shaw said.

Along with telling his story, he presented facts about car accidents in Utah. According to his presentation, there are DUI accidents every three hours, and people are injured by another in distracted driving accidents every 94 minutes.

Some students were impacted by Shaw’s presentation. T.J. Norton, 16, said he’s tried to text and drive but he doesn’t have the coordination.

“This was impactful because it was a real person, not just a generic person tell you texting is bad,” he said.

Macy Keith, 17, said Shaw’s message was powerful.

“I’ve texted while driving before,” she said. “I try not to, though. It scares me.”

The assembly was part of Red Ribbon Week, a week dedicated to remembering the dangers and prevention of drugs and alcohol abuse.

Two Injured in St George Crash

A passenger vehicle traveling west on 700 East hit a Ford Explorer Tuesday evening as it was pulling out of the Harmon’s parking lot to turn left, according to a report by The Spectrum. The collision forced the SUV to tip over. St. George Police Officer Tyrell Bangerter said each vehicle had a single occupant. The 84-year-old male driver of the SUV was the most severely injured.

“The male was conscious and breathing, so that’s a good sign,” he said. “I don’t know if he was wearing his seat belt.”

Both drivers were transported to Dixie Regional Medical Center. Bangerter said the 24-year-old female driver in the other vehicle had minor injuries, but asked to be transported to the hospital.

Ronny Sweat and her daughter Nicole Vasquez saw the accident happen while attempting to turn into the Harmon’s parking lot. Vasquez said she called 911.

Sweat said she stopped, put her flashers on and started directing traffic.

“It was just so slow,” Sweat said.

Vasquez said she went to talk to the driver in the SUV to make sure he was alert.

“People from the community just rushed together to help out,” she said.

Bangerter said the 84-year-old St. George man was flown to a Las Vegas hospital because of neck injuries.

The 24-year-old woman from Ivins, injured her ankle.

St. George Utah Accidents

Auto accidents in the St. George Utah area might see an increase since school is back in session. Watch closely for children in cross walks and along roads.
The following accidents were reported in St. George.
August 25th two accidents with damages were reported on Tabernacle, one at 900 E the other at 700 E. Also an accident on Tuweap and 2000 N.
Wednesday August 26th there were two accidents with injuries, one on Witch Hazel Circle the other on 2400 S River Road. There was also an accident with damages on Sunset and Dixie Downs Dr Wednesday.
The Spectrum newspaper reports that early Thursday morning a 59 year old women was extricated from her vehicle on Indian Hills road after crashing. An investigation is still pending.
Thursday brought one hit and run 800 E and an accident with damages 700 S River Road.
Remember to be safe, watch for children, keep your speeds down.

A fatal motorcycle accident claimed the life of one man while traveling on I15 Thursday August 6th.  Also on Thursday A Dodge Durango pulling a trailer rolled on I15 near the Bloomington exit.
A Cedar City teenager was struck by a car while crossing at an intersection Saturday.
A California man was struck and killed Saturday morning while he was traveling on his motorcycle on Telegraph.
Sunday afternoon a couple traveling on their motorcycle crashed after a deer ran in front of them on State Route 257. The female passenger died from head injuries even though she was wearing a helmet, the male passenger was taken to Delta Hospital then later flown to Utah Valley Regional Medical Center.

CEDAR CITY – A fatal crash involving three vehicles on I-15 at mile post 42 led to two deaths and six people injured early Sunday morning.

Driver Juan Garcia, 29, of Hesperia, Calif., was traveling southbound on I-15 at 4:05 a.m. with Chantel Manuel, 22, Olegario Angulo, 31, Zapatista Angulo, 3, and Assata Angulo, 5 months, all of Los Angeles, when Garcia swerved to the left to avoid a deer, according to a Utah Highway Patrol report.

Garcia’s 1993 Range Rover rolled several times and both children, not restrained in their car seats, were ejected from the vehicle, according to the report.

Olegario Angulo was seatbelted but sustained fatal head wounds from the roof and door of the vehicle, according to the report. Assata Angulo also died after suffering head injuries.

Manuel suffered injuries to the lower torso and Garcia to the head and arms, both later taken to Valley View Medical Center.

Mario Mendez, 67, of Vista, Caif., was driving a 2006 Toyota 4-Runner southbound when he saw the debris in the road but not the Range Rover, which did not have lights on, and hit it on the front right while swerving into the emergency lane, according to the report.

Mendez told UHP he got out and tried to warn oncoming traffic of the crash, but a third vehicle, driven by Jennifer A. Jordan, 47, of Rancho Santa Margarita, Calif., did not see the Rover and hit its side.

Jordan’s 2003 Toyota Tacoma spun around into the emergency lane and came to rest facing east next to Garcia’s vehicle, according to the report.

Jordan suffered a broken ankle and was LifeFighted to Intermountain Medical Center. Her son, Jeremy, 20, who suffered bruises and abrasions, was taken to VVMC and later IMC to be with his mother.

Helmet saves cyclist’s life

CEDAR CITY – A motorcyclist from Nevada is recovering at Valley View Medical Center after crashing on state Route 148 Friday afternoon.

Harvey Pearson, 55, suffers from two broken legs and several broken bones, according to Utah Highway Patrol trooper Kim Riddle, who took the call.

Pearson was traveling on SR-148 around a curve at mile post 2 at 50 mph when he lost control of his motorcycle, went over a cattle guard, rolled five or six times end over end and went through a yellow arrow curve sign, Riddle said.

“His helmet saved his life,” the trooper said, noting the severe fall and major injuries that also included head lacerations. The motorcyclist was on his way into Cedar City with eight other bikes alongside him, some of them family members, Riddle said. The trooper did not believe at the time of transport that Pearson needs a Life Flight to a larger hospital.

Dixon Truman Fisher and Clifford encourages helmet use when riding a bike

SALT LAKE CITY – Two cyclists were involved in separate auto/bicycle accidents in Salt Lake City Tuesday morning, underscoring the importance of bicycle safety. The first accident happened around 7:00 a.m. at the intersection of 400 South and 200 East. Police say the cyclist, who was not wearing a helmet, ignored a red light and was struck by a car. The accident caused a rush hour traffic jam in the area and left the cyclist in critical condition. Police say the owner of Wasatch Touring bicycle shop was the cyclist involved in a second auto/bicycle accident at 100 South and 1000 East. The cyclist was wearing a helmet and is expected to be okay. FOX 13′s Kirk Yuhnke has the details.

Law Passes – Some hit-and-run incidents a felony

Shocking Tragedy

It was a year ago this month that Connie Blount, 18, a Park City woman in her freshman year at the University of Kentucky, was struck and killed in a hit-and-run accident.

The tragedy shocked and horrified family members not only because of the death of their loved one, but also because they soon discovered Kentucky was one of just three states in the nation at that time where hit-and-run was a misdemeanor offense. The other two states were Montana and Utah.

“I was shocked. I was totally unaware it wasn’t a felony in every state. I was horrified by that fact,” said Connie’s father, Jack Blount.

Motivated by his daughter’s death, Blount worked to change Utah’s law. Now a year later, the state has a law that makes some hit-and-run incidents a felony.

Starting today, motorists involved in a hit-and-run collision in which there is death or serious bodily injury can be charged with a felony if they previously were convicted of DUI.

Blount said he would have liked to have seen all hit-and-runs involving serious injury charged as felonies, regardless of a prior DUI conviction. But the new law is a good start, he said.

“Government is a very complex organism. Any change in the right direction is exciting. I’m certainly disappointed the law isn’t broader and more straight forward,” he said. “I understand these things take time. They’re complicated. We’re continuing to push on legislation to improve for next year.” Blount says he has the full support of law enforcement to get tougher laws passed.

“Everybody I’ve talked to in law enforcement have been 110 percent on my side. They think this is an unacceptable crime. It’s growing out of control in America,” he said.

Utah has had its share of high-profile hit-and-run incidents, in addition to what seems to be a spike in the number cases in recent weeks, including five in the past two months resulting in serious bodily injury or death.

Hit and Run Incidents

May 2 — A 31-year-old woman was found unconscious in the road near 4000 West and 4400 South and taken to the hospital in critical condition.

April 20 — A 29-year-old man was critically injured after being hit by a car on 900 South near 1400 East.

April 10 — A 27-year-old woman was critically injured crossing the street in a crosswalk at 2100 South and 1200 East with her dog that was also hit and killed.

March 19 — A 57-year-old bicyclist was left lying in the road, seriously injured, after being hit by a BMW on Wasatch Boulevard.

Numerous High Profile Cases

Another high profile hit-and-run accident in Utah happened in December 2007, when a 15-year-old girl was killed while running across I-15.A random sampling of statistics from local police departments shows hit-and-run accidents keep law enforcers busy.

From Jan. 1, 2008, to May 5, 2009, Salt Lake City police responded to 1,476 hit-and-run accidents, according to the city’s crime statistics. The Salt Lake County Sheriff’s Office responded to 761 from April 2008 to April 2009, according to its records.

Sandy police have had 119 hit-and-run accidents during the first four months of 2009. There were 391 in 2008. For the past three years, the average number per month has gone up from 27.4 in 2006 to 32.5 in 2008, or at least one a day.

The statistics reflect all incidents classified as “hit-and-run,” from fatal accidents to minor fender-benders caused by drivers who back into another vehicle in a parking lot and take off without leaving a note on the windshield.

Money was the main reason the Utah Legislature didn’t approve a stronger hit-and-run bill, said Rep. Christopher Herrod, R-Provo, who sponsored the new law. Legislators feared it would result in many more people being sent through the judicial system and incarcerated. Because of that, fiscal analysts estimated that by adding the prior DUI provision, they could delay that spike in incarcerations for two years, he said.

Like Blount, who helped with the bill, Herrod said the law was a good first step. But Herrod said he plans to revisit the issue during the next legislative session in an attempt to strengthen it.

Questions about the Bill

Some law enforcers question watering down the bill for money reasons, noting that because the Salt Lake County Jail limits incarcerations, the new law really wouldn’t impact prisoner housing costs. The jail would simply be forced to reprioritize releases when overcrowding occurs.

Herrod, however, countered that theoretically a jail should be able to hold all offenders.

“Often times it takes several years to get legislation passed. It was much better than not having it on the books at all. The problem will be fixed in the future,” he said. “It’s only a matter of time before this happens on a back street and someone is left to die. That’s what I really want to avoid in the future. People should take responsibility for their actions.”

Blount said he was encouraged by the support he has received from law enforcement, not only in Utah but other states. He has also worked to change the law in Montana, now the only state in the nation without a felony hit-and-run statute.

“I think as citizens, when things are brought to our attention, we need to take action,” he said. “Certainly Connie’s death is what’s driving me to try and help protect other people.”

- HURRICANE – A two-vehicle traffic accident near the Washington County Fairgrounds resulted in the death of a St. George man Friday afternoon, according to a Hurricane Police Department spokeswoman. Spokeswoman Nancy Perkins said the 45-year-old man was killed when the Dodge truck he was driving westbound on state Route 9, on the hill between the fairgrounds and the Coral Canyon turnoff, veered across traffic into the eastbound lanes of travel at about 3 p.m. Perkins said an eastbound truck pulling a trailer attempted to avoid a collision with the Dodge but the man driving the truck over-corrected, resulting in a head-on collision, according to witness statements. Perkins said the victim was not wearing a seat belt and was partially ejected from the truck. The victim has been identified but his identity won’t be released until next of kin are notified, some time today. The driver was the lone occupant of the vehicle. The driver of the eastbound vehicle, Nicholas Novak, 24, was reportedly walking around when emergency crews arrived on the scene. His passenger, 32-year-old John Bunderson, 32, had to be extricated from the wreckage. He was taken to Dixie Regional Medical Center in St. George in serious condition, Perkins said. Perkins said both Bunderson and Novak were wearing seat belts. . . . Perkins said the incident is still under investigation but didn’t expect to issue any citations.
